Arrest for Controlled Substance

Possession of Controlled Substance

 

On 7 March 2017, Investigator Gary Dorman observed a black Jeep traveling south on Hempstead 3, cross the center line on three occasions. Inv. Dorman attempted to wait on the vehicle to reach a safe area before he attempted to traffic stop the vehicle, as there is no shoulder on Hempstead 3.

 

Before Inv. Dorman could traffic stop the vehicle, the vehicle pulled into the ditch, with half the vehicle still out in the lane of traffic Inv. Dorman felt that this was unsafe and pulled behind the vehicle with his emergency lights on. When Inv. Dorman activated his emergency lights, the vehicle's passenger immediately became visibly nervous, began moving around very quickly inside the vehicle, and then opened his door. Inv. Dorman exited his vehicle and made contact with the passenger, Patrick Davis.

 

            Inv. Dorman asked Patrick if everything was alright. Patrick stated that everything was fine and "we just stopped so I could relieve himself. Inv. Dorman noticed a strong odor of marijuana coming from the vehicle and that Patrick was holding a cigar wrapper that is commonly used to smoke marijuana. Inv. Dorman inquired about the cigar wrapper and Patrick stated "It's a blunt".

 

Inv. Dorman then asked Patrick to step out of the vehicle and took possession of the cigar wrapper and noticed that it was full of what is believed to be marijuana. Inv. Dorman advised Patrick to put his hands behind his back and that he was being detained for possession of marijuana.

 

Inv. Dorman was handcuffing Patrick and observed a baggie containing a green vegetable substance lying on the ground underneath the vehicle right under Patrick's door. Inv. Dorman asked Patrick what the bag on the ground was and he stated that it was the marijuana he was using to roll in the cigar wrapper. Inv. Dorman observed another baggie lying on the ground next to the baggie of suspected marijuana. Inv. Dorman noticed that the baggie had a white rock like substance inside of it. Based on Inv. Dorman's training and experience he believed the substance was crack cocaine. Inv. Dorman retrieved the bag which contained a white substance and advised Patrick that he was under arrest for possession of cocaine.
